Personal Electronic Equipment Terms of Service for Accidental Breakage/Liquid Breakag

The Terms of Service in this document (“T&C”) describe the services available to you following your purchase of Accidental Breakage/Liquid Breakage (“Product”) provided by bolttech Device Protection Philippines, Inc. (“bolttech”).

By purchasing the Product, providing us with your details, and accessing this T&C, you affirm that you are voluntarily giving your consent to be bound by the terms and conditions of this T&C.

bolttech may amend or alter this T&C from time to time for which you will be notified accordingly through the contact details that you provided to us at the time of purchase of the Product.

This is an electronically generated document. By purchasing the Product, you are deemed to understand the features of the Product and your access to this Terms of Service shall be deemed as your consent to the Terms of Service.

By accessing this Terms of Service and your continued use of the Product and services provided under this Terms of Service, you hereby affirm that you have voluntarily given your consent to be bound by this Terms of Service including any future amendment or changes.




1. Definitions
  • 1.1 Personal Electronic Equipment: Electronic equipment which should be for personal use only and not to be used for commercial, rental, or profit generation purposes.
  • 1.2 Normal Use: Use of the Personal Electronic Equipment in accordance with the guidelines issued by the relevant manufacturer/distributor of the Personal Electronic Equipment including but not limited to regular maintenance and upkeep of the Personal Electronic Equipment, usage of specified protection devices such as voltage stabilizers.
  • 1.3 Accidental Breakage: Any visible breakage occurring to the Personal Electronic Equipment during the Period of Service, by involuntary and external means.
  • 1.4 Liquid Breakage: Any breakage occurring to the Personal Electronic Equipment during the Period of Service, by an involuntary seepage of water or other fluids inside the Personal Electronic Equipment.
  • 1.5 BER: ‘Beyond Economic Repairs’ means cost of a repair is equal to or greater than 80% of the Personal Electronic Equipment Price (Recommended Retail Price).
  • 1.6 Service Fee: Fee payable by you at the time of registering an Accidental Breakage or Liquid Breakage repair request service with us.
  • 1.7 Immediate Family Member: Means Customer’s spouse and/or child/ren.
  • 1.8 Personal Electronic Equipment Price (Recommended Retail Price): Your Personal Electronic Equipment purchase price at the date You purchase the Personal Electronic Equipment as shown in the relevant receipt of purchase.
  • 1.9 Start Date: The date you purchase the Product which is shown on the receipt of purchase.
  • 1.10 Manufacturer’s Warranty: The original warranty issued by the manufacturer of the Personal Electronic Equipment.
  • 1.11 Dead on Arrival (DOA): A policy put in place by manufacturer or retailers to cover the Device’s replacement or return in case of defect or damage during transit to the buyer.



2. Services and Scope of Repair
  • 2.1 The Product will provide you with repair/replacement service for any Accidental Breakage or Liquid Breakage of your Personal Electronic Equipment for a period of 1 (one) year from the Start Date (“Period of Service”), with the following details:
    • You are entitled for repair service(s) up to the Personal Electronic Equipment Price (Recommended Retail Price) during the Period of Service.
    • Easy repair request registration.
    • 7 days a week call centers and dedicated repair requests portal.
    • Free pick up & delivery service (subject to terms and conditions).
    • Overseas Protection by providing repair services upon return if you travel abroad (for a single trip) for up to 60 calendar days.
  • 2.2 Repairs requested under this T&C shall subject to the following conditions:
    • The details relating to a repair and value of any repair(s) or replacement(s) (if Accidental Breakage or Liquid Breakage is BER) required is to be assessed and determined solely by bolttech and shall be final and conclusive.
    • A refurbished unit may be used as a replacement unit.
    • Repairs performed exclusively by the authorized service center.
    • The Personal Electronic Equipment must:
      • have been purchased new in the Philippines;
      • have been manufactured/distributed in the Philippines;
      • have been sold by authorized dealer supported by an invoice and Personal Electronic Equipment manufacturer’s warranty;
      • at all times have been used in accordance with the Normal Use of the Personal Electronic Equipment;
      • not have been altered or modified at any time;
      • have been used for personal use only and not for commercial, rental, or profit generation purposes; and
      • have been mainly used by You and Your Immediate Family Member and had been in your ownership (or Immediate Family Member as relevant) only.
    • The Manufacturer’s Warranty must not have been voided or affected by any action by You.
    • In performing repair, bolttech shall have the option in our discretion, without prejudice to this T&C:
      • to replace the Personal Electronic Equipment with a similar or equivalent model, based on features and functionality (whether new or used), in the case of BER. The replaced Personal Electronic Equipment (the broken unit) shall become a property of bolttech. The replacement Personal Electronic Equipment may be of lower retail value than the original Personal Electronic Equipment. You will be responsible to backup and restore any data You may have from the replaced Personal Electronic Equipment to the replacement Personal Electronic Equipment, where relevant. bolttech will not be responsible for any loss and/or damage to data.
      • to sub-contract repair or any part of it.
  • 2.3. Other key conditions applicable to the repairs under this T&C:
    • This T&C is only valid for your Personal Electronic Equipment provided by you during the purchase of the Product. This T&C is not assignable or transferable by you or to another device, for any reason (including but not limited to the Personal Electronic Equipment being sold to a third party), other than in the case set out in paragraph (b) below.
    • This T&C is transferable to another Personal Electronic Equipment only in the event of:
      • the Personal Electronic Equipment being replaced by the Personal Electronic Equipment manufacturer due to Manufacturer’s Warranty fault that cannot be repaired; or
      • a replacement device is given to you in accordance with clause 2.2 (f) above.
  • 2.4. This T&C shall continue to cover the replacement device referred in clause 2.2 (f) and 2.3 (b) above provided that You notify bolttech through the method mentioned in “Repair Request Process” section below. You shall notify bolttech in the following manner: (a) in the case of the DOA, within 30 days from the date of the invoice; (b) of the details of the replacement device within 30 days from the date of your receipt of the replacement device. The Personal Electronic Equipment model and IMEI number will be updated accordingly.
    For these purposes, “DOA” or “dead on arrival” refers to a Personal Electronic Equipment (i) being purchased and not taken immediately from a physical outlet and which is later delivered to you; (ii) upon delivery is found to be completely inoperative; and (iii) is immediately returned the outlet where you purchased the Personal Electronic Equipment for replacement.



3. What is Not Included
  • This T&C is only for Accidental Breakage or Liquid Breakage based on the terms set out in this T&C, and for the avoidance of doubt, does not include repair or services of or for the following:
  • 3.1 Replacement of or support for data, software, music etc. i.e. any data stored on the Personal Electronic Equipment.
  • 3.2 Replacement of any consumable items or accessories like batteries, chargers, headphones etc
  • 3.3 Cosmetic breakage to the Personal Electronic Equipment, such as breakage to paintwork, Personal Electronic Equipment finish, dents or scratches.
  • 3.4 Any defects that are subject of the Personal Electronic Equipment manufacturer recall.
  • 3.5 Cost that You incurred by Yourself to repair the Personal Electronic Equipment with a third party.
  • 3.6 Breakage arising from war, war like operations (whether war declared or not), act of foreign enemy, hostilities, civil war, rebellion, insurrection, civil commotion, military usurped power, seizure, capture, confiscation, arrest, restraints and/or detainment by order of any government or any other authority.
  • 3.7 Any form of physical loss or untraceability of the Personal Electronic Equipment, or any form of consequential or incidental loss suffered by you in respect of the Personal Electronic Equipment.
  • 3.8 Accidental Breakage or Liquid Breakage arising from overload, experiments or tests requiring the imposition of abnormal conditions.
  • 3.9 Gradually developing flaws, defects, cracks or partial fractures in any part, although at some future time repair or renewal of the parts affected may be necessary.
  • 3.10 Deterioration of or wearing away or wearing out of any part, marring or scratching of the Personal Electronic Equipment caused by external force or naturally resulting from normal use or exposure.
  • 3.11 Any type of electrical or mechanical breakdown including electrical failure or short-circuit.
  • 3.12 Breakage arising from manufacturing defect.
  • 3.13 Breakage arising from attack by unauthorized software/virus, software faults.
  • 3.14 Accidental Breakage or Liquid Breakage arising out of any intentional act towards the Personal Electronic Equipment including but not limited to incorrect installation or incorrect set-up.
  • 3.15 Fire, flood, earthquake and any other convulsions of nature.
  • 3.16 Breakage to any electronic data and/or Personal Electronic Equipment software/operating system, storage media, data/records or similar intangible items and breakage to the SIM card/memory card of the Personal Electronic Equipment not caused by manufacturing defect.
  • 3.17 Accidental Breakage or Liquid Breakage arising from internal leakage of the battery.
  • 3.18 Any failure of the Personal Electronic Equipment to operate as a result of problems with respect to the network infrastructure, Your network subscription or similar service issues.
  • 3.19 Any Service Request where we discover deception, fraud, and illegal use of the Personal Electronic Equipment.



4. Repair Requests Process
  • 4.1 Repair request for Accidental Breakage or Liquid Breakage must be submitted within 30 calendar days from the date when the accident occurred. Otherwise, bolttech reserves the right to deny the repair request.
  • 4.2 Notify bolttech of Accidental Breakage including Liquid Breakage or by: (i) registering on the online portal at https://device.bolttech.ph/service-request ; or (ii) calling 093 405 7718/ 0945 601 3601, Mondays through Fridays from 9am to 5pm (including public holidays).



5. Termination
  • The Product will be immediately and automatically terminated in the following events. In such case, no refund will be due to you.
  • 5.1. Where the IMEI number of the Personal Electronic Equipment is removed, obliterated or altered from the Personal Electronic Equipment; or
  • 5.2. If repairs have been conducted by unauthorized repair centers or person at any point during the Period of Service; or
  • 5.3. Where You have exhausted the maximum number of repairs in accordance with clause 2.1.a. above; or



6. Governing Law & Jurisdiction
  • The construction, interpretation and meaning of the provisions of this T&C shall be determined in accordance with Philippine laws and by the Philippine courts. You acknowledge and agree to comply with any and all applicable laws and regulations in using the Service



7. Grievance
  • In case of any grievance, You may contact us at 0939 405 7718/ 0945 601 3601, Mondays through Fridays from 9am to 5pm (including public holidays).



8. Data Privacy
  • bolttech respects Your privacy. In order to make the Services available to you and process the transactions made by you, bolttech and/or its partners may collect certain information and personal data from you, and use, process and/or disclose such information and data in accordance with our Privacy Policy. You agree that to provide the Services, bolttech and/or its partners may transfer information related to you and/or your personal data to subcontractors or affiliates related to this Service. bolttech may update the Privacy Policy, time to time, so please periodically review the Privacy Policy.

    You agree to provide accurate, current, and complete information required to register with the Services and at other points as may be required in the course of using the Services. The data or information you provided may be used by bolttech in conducting our internal services, marketing campaigns, and surveys to be used for future product offerings and service enhancement. bolttech may terminate Your rights to any or all of the Services if any information you provide is false, inaccurate or incomplete. You agree to the use of your data in accordance with bolttech’s privacy policies. You may change your registered personal details by notifying bolttech, however you are not allowed to change the registered name (save for situation of misspelling of your name or any similar situation).



9. Warranties & Liability
  • The services are provided “as is” and “as available”. bolttech makes no representations or warranties or guarantees of any kind of nature, whether express or implied, regarding the services beyond the scope of this T&C.

    In no event shall bolttech shall be liable for any general, consequential, incidental, indirect, special, loss of profit or opportunity, exemplary, punitive special or other damages/loss whatsoever. Resulting from bolttech’s performance or failure to perform under this T&C. Except where expressly provided in this T&C, in no event shall bolttech’s liability exceed the amount paid by You under this T&C. Except where expressly provided in this T&C, the damage limitations provided in this T&C and the remedies stated herein shall be your sole and exclusive remedy. This limitation on liability shall survive failure of any essential purpose.

    You agree to indemnify, defend, and hold harmless bolttech, its contractors, employees, and agents from any claims, losses, damage, liabilities (including legal fees and expenses) arising out of your use of the Service, your violation of the rights of any third party, or any breach of these T&C.



10. Force Majeure
  • 10.1 bolttech is not liable or responsible for any failure to perform, or delay in performance of any obligations under this T&C that is caused by events outside reasonable control ("Force Majeure Event"), in particular (without limitation) (a) unavailability of public or private telecommunication networks (b) acts, decrees, legislation, regulations or restrictions of any government or (c) strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or any natural disaster.
  • 10.2 bolttech’s performance under this T&C is deemed to be automatically suspended for the period that Force Majeure Event continues, and bolttech will have an extension of time for performance for the duration of that period.
  • 10.3 bolttech will use its reasonable efforts to bring the Force Majeure Event to a close or to find a solution by which bolttech’s obligations under this T&C may be performed despite the Force Majeure Event.
